Welcome to TAI PERERAU - Tahitian Dance School. Our website www.sydneydancecompany.com and its associated domains and apps (“ Sites ”) are operated by TAI PERERAU - Tahitian Dance School (collectively, “ TAI PERERAU ”, “ us ”, “ our ” or “ we ”).
By accessing or using our Sites and/or Services, you agree to be legally bound by the following terms and conditions (the “ Terms of Use ”).
Please read these Terms of Use carefully. If you do not agree with any part of these Terms of Use you should refrain from using the Sites and/or Services. We may change, modify, add or delete portions of the Terms of Use from time to time at our sole discretion and your continued use of the Sites and/or Services constitutes your acceptance of those changes.
It is your responsibility to regularly check and/or review these Terms of Use and to decide whether you agree to abide by them and be bound by them. If you do not agree to be bound by or abide by these or any future Terms of Use, please do not use or access (or continue to use or access) the Sites and/or Services.
1. Access and Use:
1.1 You must not use the Sites and/or Services, in any manner or for any purpose which is unlawful or contrary to these Terms of Use.
1.2 TAI PERERAU reserves the right to elect not to provide the Services to you, process any order you place or allow you access to the Sites, as a result of any conduct that TAI PERERAU, in its sole discretion, believes may breach the law, infringe these Terms of Use, violate the rights of TAI PERERAU or third parties, or is otherwise inappropriate for continued access and use of the Sites and/or Services.
2. Classes On Demand Membership:
2.1 You may subscribe to the Classes On Demand membership (“Dance Membership”) via [link].
2.2 There is no minimum term for Classes On Demand Membership, you may cancel at any time.
2.3 During the term of your Membership, you shall be entitled to access unlimited On-Demand dance classes, which can be viewed online (this does not include courses, master classes, special workshops, youth term classes or school holiday workshops).
2.4 Your access to the Member Benefits cannot be transferred to another party.
2.5 Your Dance Membership will include eligibility to receive information about other promotional discounts or benefits ("Promotional Benefits") at TAI PERERAU’s sole discretion. TAI PERERAU reserves the right to offer, withdraw, change, cancel or determine your eligibility for any Promotional Benefits in our sole discretion. Promotional Benefits may be subject to terms and conditions which shall apply in addition to, and prevail to the extent of any inconsistency with, these Terms of Use.
2.6 By participating in a TAI PERERAU On Demand Class, you agree and acknowledge the following terms and conditions:
a) Online dance classes can involve risk of personal injury, and that risk is accentuated by participation outside the controlled environment of our own studios. While TAI PERERAU takes all reasonable care in the conduct of its classes, it accepts no responsibility for injury or loss caused during the classes or whilst participants are participating in an online class session;
b) You or your legal guardian are responsible for ensuring that you are physically and medically fit for the class;
c) During the class you must take care at all times of your own personal safety;
d) Students must not attempt an online class, or any part of a routine, that is beyond their level of ability;
2.7 Payment for Dance Membership:
(a) By subscribing to Classes On Demand Membership and providing us with your valid credit card details, you authorise us to charge you at the current rate on a monthly, quarterly or annual basis in accordance with the payment terms found at [link] (“Payment Terms”).
(b) Your billing cycle will begin on the date that you sign up for your Dance Membership or the date you set up and will be renewed on the same date each month, quarter or year (your “Billing Cycle”).
(c) You may incur additional fees for late or declined payments, in accordance with the Payment Terms.
(d) Unless cancelled by you in accordance with Section 2.9 below, your Classes On Demand Membership will continue, and you will continue to be charged the applicable current fee for each Billing Cycle in accordance with the Payment Terms.
(e) We may increase the subscription fees for Classes On Demand Dance Memberships at any time by giving you at least one (1) month notice except where such increase is required by law or any regulatory authority (in which case we will try to give you reasonable notice).
(f) You must inform TAI PERERAU of any change in your contact details, bank accounts or credit card details for payment, as well as in relation to any other information relevant to your Dance Membership.
(g) All purchases are final, non-refundable and non-transferable.
2.8 Suspension:
(a) You may suspend your Classes On Demand Dance Membership.

or by otherwise contacting TAI PERERAU.
(b) During a valid Suspension, you will not be charged any Classes On Demand Membership fees.
(c) All Dance Membership fees must be paid up to date prior to requesting a Suspension.
(d) The minimum duration of a Suspension is two (2) consecutive weeks. You may continue your Suspension in fortnightly periods thereafter up to a maximum of twelve (12) weeks.
2.9 Cancellation:
(a) You may cancel your Classes On Demand Membership by contacting TAI PERERAU (“Cancellation Notice”) at least 72 hours before your next payment is due. You will not need to pay any further billing cycle. You will not be eligible for any credit or refund for unused access.
(b) Upon cancellation taking effect, your Classes On Demand Membership and access to the Member Benefits shall cease.
(c) TAI PERERAU reserves the right to suspend or cancel your Classes On Demand Membership in its sole discretion due to unpaid fees. TAI PERERAU also reserves the right to refuse future Membership to you in these circumstances.
(d) TAI PERERAU reserves the right to cancel your Classes On Demand Membership if you breach these Terms of Use or if your behaviour is not acceptable or for any other reason at its sole discretion. TAI PERERAU also reserves the right to refuse future Dance Membership to you in these circumstances.
(e) You will not be refunded for unused Classes On Demand Membership periods.
2.10TAI PERERAU reserves the right to change the terms and conditions of Dance Membership and the Member Benefits at any time, at its sole discretion. We will notify you of any change prior to the date such change comes into effect via email sent to the email address you provided when creating your Dance Membership. If any such change has a materially detrimental effect on you, you may cancel your Dance Membership in accordance with Section 2.11 below.
3.1 Before attending a dance class (“Class”or “Classes”) at TAI PERERAU, participants must provide TAI PERERAU with their full name, phone number and email address. TAI PERERAU will also request that you provide your physical address and postcode, although you are not required to provide this information. If the participant is younger than eighteen (18) years of age, their date of birth is required.
3.2 By entering a TAI PERERAU dance studio, you agree and acknowledge the following terms and conditions:
a) Classes can involve risk of personal injury. While TAI PERERAU takes all reasonable care in the conduct of its Classes, it accepts no responsibility for injury or loss caused during the classes or whilst participants are at or near the studios. Please consult a doctor before commencing a new fitness program;
b) You or your legal guardian are responsible for ensuring that you are physically and medically fit for the Class;
c) During the Class you must take care at all times of your own personal safety;
d) Entry to the Class more than fifteen (15) minutes after the start time is prohibited, as you must participate in the warm-up exercises at the start of the class;
e) Students must not attempt a Class, or any part of a routine, that is beyond their level of ability;
f) Be respectful and do not behave inappropriately towards other members, guests, our staff and outside providers. Examples of inappropriate behaviour include verbal or physical intimidation, harassment, discrimination on the basis of race, sex, age or any disability another person may have;
g) You or your legal guardian are responsible for your own belongings. TAI PERERAU does not accept responsibility for any lost, stolen or damaged property; and
h) TAI PERERAU takes all reasonable care to minimise risk of infection of COVID-19 at its premises, however you attend at your own risk and it accepts no responsibility for illness or loss caused by attending a Class or related activity. You can find out more about our Safety Assurance here.
i) You will not attend a Class at TAI PERERAU if you have a current positive COVID-19 test result, are awaiting the result of a COVID-19 test, have come into contact with a known case of COVID-19 or are experiencing symptoms of cough, sore throat, shortness of breath or fever.
4. Member Account:
Password and SecurityIf you register on the Website, you will be required to choose a password and user name, and you may be asked for additional information regarding your account, such as your e-mail address. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify TAI PERERAU of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out from your account at the end of each session. You may never use another Member’s account without prior authorization from TAI PERERAU . TAI PERERAU will not be liable for any loss or damage arising from your failure to comply with this Agreement.
5. Prohibited Conduct:
You agree not to use the Service to post or otherwise transmit information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (“Content” means the transmission of information, data, text, software, music, sound, photographs, graphics, video, messages, tags or other materials generated by a user) that: is patently offensive and/or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; harasses or advocates harassment of another person; exploits people in a sexual or violent manner; contains nudity, violence, pornography, sexually explicit material or offensive subject matter; provides any telephone numbers, street addresses, last names or email addresses of anyone other than your own; promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;violates any intellectual property or other proprietary right of any third party, including Content that promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files; involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”;contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses; solicits passwords or personal identifying information from other Members; involves commercial activities and/or sales without TAI PERERAU's prior written consent, such as contests, sweepstakes, barter, advertising, and/or pyramid schemes; includes a photograph of another person that you have posted without that person’s consent or otherwise constitutes an invasion of an individual’s privacy or infringement of publicity rights; denigrates, ridicules, or demeans another person; or contains a virus or other harmful component.
You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses the Website in a manner that sends more request messages to the TAI PERERAU servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.
6. Responsibility for Content
You, and not TAI PERERAU, are entirely responsible for all Content that you post, email, transmit or otherwise make available via the Website. TAI PERERAU does not control the Content posted via the Website and, as such, we do not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that you deem offensive, indecent or objectionable. Under no circumstances will TAI PERERAU be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred at any time as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.
7. Rejection/Removal of Content
You acknowledge that TAI PERERAU may or may not pre-screen Content posted on the Website, that TAI PERERAU is not responsible for behavior or comments of teachers and/or students and/or music on the Website, but that TAI PERERAU shall have the right (but not the obligation) in its sole discretion to pre-screen, edit, refuse, or remove any Content or portion thereof that is available via the Service, for any reason. Without limiting the foregoing, TAI PERERAU shall have the right to remove from the Website any Content that violates this Agreement or is otherwise objectionable in the sole discretion of TAI PERERAU.If you become aware of misuse of the Service by any person, please contact TAI PERERAU.
8. Security Components
You understand that the Website and software embodied within the Website may include security components that permit digital materials to be protected, and that use of these materials is subject to usage rules set by TAI PERERAU and/or content providers who provide content to TAI PERERAU. You may not attempt to override, disable, circumvent or otherwise interfere with any such security components and usage rules embedded into the Website.
9. Proprietary Rights
All materials on the Website, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements (collectively, “Material”) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by TAI PERERAU or by third parties that have licensed or otherwise provided their material to TAI PERERAU. You acknowledge and agree that all Materials on the Website are made available for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere on this Website, no Material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without TAI PERERAU’s prior express written permission. You may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or to utilize the Website or any part of the Material for any purpose other than its intended purposes is strictly prohibited.
10. Non-commercial Use
The Service may not be used in connection with any commercial purposes, except as specifically approved by TAI PERERAU. Unauthorized framing of or linking to any of the Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles and Content without notice and may result in termination of membership privileges.
